Санжаачойпэл нарын хэрэг бол сүүлийн жилүүдэд Монголд “шударга ёс” гэдэг ойлголт ямар үнэ цэнэтэй, хэнд зориулагддаг вэ гэдгийг хамгийн тод харуулсан жишээ болов. Энэ бол жирийн нэг зодоон биш, харин манай нийгэмд хууль эрх мэдэлтэй хүмүүсийн өмнө хэрхэн “уян зөөлөн” болж хувирдгийн илрэл юм.

2025 оны долоодугаар сард Улаанбаатар хотын шөнийн цэнгээний газрын гадаа хэдэн залуус нийлж ганц хүнийг бүлэглэн зодож, эрүүл мэндэд нь хүнд гэмтэл учруулсан хэрэг гарсан. Хохирогч эмнэлэгт хүргэгдэж, нүүрний яс нь хугарч, насан туршийн суулгац хийхээс өөр аргагүй болсон нь угтаа хүний амьдралыг үндсээр нь өөрчилсөн ноцтой халдлага байлаа.

Хэрэгт УИХ-ын гишүүн асан Цэрэнпунцагийн хүү Санжаачойпэл, “Эрэл”-ийн Эрдэнэбатын хүү Тэмүүлэн, Таванбогд группын үүсгэн байгуулагч Баатарсайханы хүү, “Говь” ХК-ийн гүйцэтгэх захирал Амарсайхан, мөн Л.Алтан-Очир нар холбогдсон. Өөрөөр хэлбэл, манай нийгэмд аль хэдийн өөрсдийгөө “дархлаатай” мэт авирладаг баян айлын хүүхдүүд байв. Тиймээс мөрдөн шалгах ажиллагаа сунжирч, шүүх хурал хойшилж, бүр Амарсайхан нь гадагшаа гарсан гэх мэдээлэл цацагдахад олон хүн “ингэх нь аргагүй” хэмээн хүлээж авсан нь өөрөө хуульд итгэх итгэл ямар түвшинд хүрснийг харуулж байлаа.

Тэгээд ч болоогүй Хохирогч Д.Саяннямбууг Санжаачойпэлийн биед халдсан хэргээр яллагдагчаар татсан ч шүүх хурлын үеэр тэрбээр:
“Би Ц.Санжаачойпэлд гэмтэл учруулаагүй. Цагаатгаж өгнө үү” гэж хүссэн байна.

Харин Ц.Санжаачойпэл:
“Хохирогч, түүний гэр бүлээс уучлал хүсэж байна. Танхай ажиллагааг нарийвчлан шалгаж, бидний ирээдүйд хамгийн хөнгөн ял оноож өгнө үү. Хожим улс эх орондоо хэрэгтэй зүйл хийх хүний хувьд гуйж байна” гэж мэдэгджээ.

Э.Тэмүүлэн “Болсон бүх явдалд харамсаж байна” гэж хэлсэн бол, Л.Алтан-Очир “Тэнд ийм зүйл болохыг нэг ч хүн төсөөлөөгүй” гэж тайлбарласан байна.
Б.Амарсайхан “Саяннямбууг би цохиогүй. Зодоог салгах гэж хичээсэн. Хохирогч үүсгэсэн хохиролд нь гэмшиж байна” гэж мэдэгджээ.

Шүүгдэгчид хохирогч Саяннямбууд нийт 1 тэрбум 670 сая төгрөгийн нөхөн төлбөр олгосон гэжээ.


Мөн Шүүх хурлын үеэр танилцуулсан гэрчийн мэдүүлэг анхаарал татав. Гэрч хэлэхдээ:
“Ц.Санжаачойпэл Тулгат бид хоёр дээр ирээд ‘Би Монголын хамгийн баян хүн. Занданшатар өнөөдөр Ерөнхий сайд болсон. Тийм болохоор би хүн алаад шоронгоос зүгээр гарч ирнэ, та нарыг алчхаад ч зүгээр гарах боломжтой’ гэж орилж эхэлсэн” гэжээ.

Харин Ц.Санжаачойпэл үүнийг няцааж:
“Ерөнхий сайдын тухай би яриагүй. Миний аав Өлзийсайхан Монголын цагдаагийн байгууллагад ажилладаг, хууль хэрхэн үйлчилдгийг харуулах гэж олон удаа хэлсэн. Аавыг нь Г.Занданшатар Ерөнхий сайд болоод ЦЕГ-ын даргаар томилсон гэж би мэдсэн” хэмээсэн байна.

Уг хэрэг анх Цагдаагийн ерөнхий газрын дарга Болд хурандаагийн хүү Өлзийсайханаас эхэлсэн хэдий ч, аав нь албан тушаалтай учир хүү нь зөвхөн гэрчийн мэдүүлэг өгч, яллагдагчаар татагдаагүй гэх яриа ч олон нийтийн дунд гарсан юм.

Уг зодоонд дээрх залуус дөрвүүлээ нийлж хохирогч Саяннямбуугийн биед халдсан нь камерын бичлэгээр нотлогдсон. Хохирогч шүүхэд мэдүүлэхдээ:

“Миний нүд, хамар маш хүнд гэмтсэн. Нүүрний яснууд хугарч мах руугаа орсон байсан. Нүүрний яснуудыг төмрөөр бэхэлж, нүдэнд насан туршийн суулгац хийсэн...”

гэж ярьсан нь энэ хэрэг жирийн маргаан биш, хүний эрүүл мэнд, амьдралд урт хугацааны нөхөшгүй хор уршиг учруулсан гэмт хэрэг байсныг илтгэнэ. Гэвч шүүх үүнийг “хөнгөн гэмтэл” гэж ангилсан нь олон нийтийн бухимдлыг улам дэвэргэв.

2026 оны нэгдүгээр сарын 29-нд Баянзүрх, Сүхбаатар, Чингэлтэй дүүргийн Эрүүгийн хэргийн анхан шатны тойргийн шүүх шийдвэрээ танилцуулж, Эрүүгийн хуулийн 11.4 дүгээр зүйлээр:

  • Ц.Санжаачойпэлд — 1 жилийн хугацаатай зорчих эрх хязгаарлах,
  • Э.Тэмүүлэн, Л.Алтан-Очир, Б.Амарсайхан нарт — 8 сарын хугацаатай зорчих эрх хязгаарлах ял оногдуулав.
    Мөн хохирогч Саяннямбууг Санжаачойпэлийн биед халдсан хэргээр яллагдагчаар татаж, 1 сая төгрөгийн торгох ял оногдуулсан байна.

Эндээс ганцхан асуулт урган гарна: хэрэв энэ хэрэгт жирийн айлын хүүхдүүд холбогдсон бол ял ийм “зөөлөн” байх байсан уу? Шөнийн гудамжинд ганцаараа явсан хүнийг бүлэглэн зодсон жирийн залуу зорчих эрхээ хязгаарлуулаад л өнгөрдөг жишээ Монголд хэр олон билээ? Иргэдийн бухимдал яг эндээс эхэлж байна. Хууль баян айлын хаалгыг зөөлөн тогшиж, ядуу айлын хаалгыг өшиглөж ордог мэт ойлголт нийгэмд аль хэдийн тогтчихжээ.

Санжаачойпэл нарын хэрэг бол ганц зодооны түүх биш. Энэ бол “хэний хүүхэд вэ” гэдгээс шалтгаалан ял шийтгэл өөр өөр болдог тогтолцооны илрэл мэт харагдсан явдал. Шүүх заалтаа уншиж, хуулиа тайлбарласан байж магадгүй. Гэхдээ шударга ёс гэдэг зөвхөн заалт уншихыг хэлдэггүй энэ бол иргэдийн итгэл, ёс зүйн хариуцлага, нийгмийн мэдрэмжийн нийлбэр юм. Харин энэ хэрэгт тэдгээрийн аль нь ч мэдрэгдсэнгүй.
